RE: Preliminary Analysis of Federal and State Requirements


IDEA 2004 requires states to 1) identify any state-imposed requirement that is not required to implement federal special education law and 2) minimize the number of such requirements. To begin this task, DPI compared state and federal law and developed the attached preliminary mark-up of the state statute (subch. V of ch. 115) and state rule (PI 11). The attached state statute/rule mark-up is as follows:

To create a visual representation that is designed to facilitate discussion, state requirements that are also included in federal law are lined through and are followed by the corresponding federal citation.

In a few instances, where state and federal law are related but not identical, we have included the actual federal language in shaded font following the state language.

Stakeholder input is being sought regarding whether any changes to state law are necessary or appropriate in response to IDEA 2004. This mark-up is offered as a tool to use in that discussion.
